LET IT BE RECORDS AUCTION POLICIES AND REGULATIONS

Please read the following information carefully. By bidding in the Let It Be auction you are accepting the terms of the policies and regulations stated here.

The Let It Be Records auction is a live, real-time Internet auction. Bids submitted are automatically posted, with the highest bid being the posted bid. Bids are also accepted via mail, fax, email or phone. To mail, fax, email or phone bids, your bid must be received by the closing day of that month's auction. All auctions end on the day and date specified on the auction homepage. Auctions begin begin by mid-week following the close of the previous auction. Bids are accepted as follows:

Internet bids: http://www.letitbe.com.
Deadline for Internet bids for the auction is 6 p.m. CST on the last day of the auction.

E-mail bids:letitbe@bitstream.net
Email bids for the auction will be accepted until 5 p.m. CST on the last day of the auction.

Mail bids:
Let It Be Records, 8225 Upland Circle, Chanhassen, MN 55317-9626. All mail bids for the auction must be received on or before the day prior to the last day of the auction.

Telephone bids:(952) 361-3015.
Telephone bids will be accepted until 5 p.m. CST on the last day of the auction.

All bids must be accompanied by your bidder number, name, address, telephone number and the lot number for each bid.

REGISTERING TO BID

All potential bidders are required to register in order to participate in our auction. You can register via the Internet, email, fax, or mail. The bidder ID number you receive is required to bid in the auction and is good for all Let It Be Records auctions. To register for a bidder ID number you must provide us with your first and last name, complete mailing address, telephone number and email (if available).

Once you receive a bidder ID number, it is your responsibility to retain this number. It is important that you retain your individual bidder ID number as we do not want bidders to hold multiple ID numbers. If for some reason you forget your bidder ID number, you can look it up from our auction homepage using the "I Forgot My Bidder Number" function, or contact us and we will look it up for you. Bidders must register by 5 p.m. CST on the last day of any given auction.

Let It Be Records reserves the right to accept or deny any or all bids by any bidder. We cannot accept any bids from minors.

RECORDS


All records in the auction are graded and defined according to the following guide. This grading guide also includes the condition of record covers which in some instances may be listed separately from the condition of a record. Let It Be Records does not guarantee that any other collector or dealer will grade a record in the same condition that Let It Be Records has. Let It Be Records does try to be as accurate and conservative in its grading as possible. We are happy to provide detailed information on a particular record if you contact us via email by 5 p.m. CST the day before the end of the auction at the latest.

SS: Still Sealed (read the return policy* concerning sealed record purchases). M: Mint; never played or in perfect condition.
M-: Mint minus; close to mint but with some minor imperfections.
VG+: Very Good Plus; a record that has been played but has no major flaws of any sort.
VG: Very Good; a record with noticeable flaws which should not affect play although there may be surface noise, or record covers with noticeable ring wear.
VG-: Very Good Minus; a record with noticeable flaws which could possibly affect play and definite surface noise, or record covers that are damaged in some way.
G: Good; a record with noticeable flaws which could possibly affect play and definite surface noise, or record covers that are damaged in some way.
F: Fair; a record that is very worn but should play with minimal or no skipping, or record covers that are damaged.
P: Poor; a record that is most likely unplayable but may fill that hole in your collection, or record covers that are very damaged.

BIDDING

Each lot listed has a minimum bid. Our minimum bids are kept low to encourage involvement. Due to the volume of our inventory, in some instances, Let It Be Records may have multiple copies of a record although this may not be indicated in our auction listings. Please be aware that although you may not have the highest listed bid in a particular lot, it is still possible that you may have a successful bid.

All current highest bids for items are listed on our web site, www.letitbe.com. For your convenience, you will automatically be notified via email any time a current bid of yours has been raised by another bidder. If you do not have Internet access, you may contact us via phone at (952) 361-3015 the last day of the auction between 10 a.m. to 5 p.m. We will not accept phone calls after 5 p.m. on the last day of an auction.

ALTERNATIVE BIDDING METHODS

Ceiling Bids: When you place a Ceiling Bid, you are giving us permission to bid for you, up to a certain dollar amount that you have set for a specific lot. If the bid goes higher than that, your bid is automatically cancelled for that item. This allows you to remain active on a lot without the need for multiple transactions. The Let It Be Records Ceiling Bid system will only raise the bid in minimum increments in response to a competing bid, so you are sure to get the lot for the lowest possible price. In the event of multiple Ceiling Bids at the same level, the earliest bid received will be honored. To activate a Ceiling Bid, you must email us at letitbe@bitstream.net or call us at (952) 361-3015 by 5 p.m. the last day of the auction.

WINNING BIDS


Invoices: Invoices will be sent to winning bidders within five working days following the last day of the auction. Invoices will be sent either via email or mail. (Invoicing via email is the preferred method.)

Payment: Payment for winning bids must be received within 10 days of notification. Internet credit card payments: Let It Be uses a secure commerce server which allows you to safely purchase items via our web site with your credit card. You only need to submit your credit card number once; we will keep it on file once you have placed an order. We accept VISA, M/C, Discover, American Express. We also accept the following: Money Order, Cashier's Check, or Certified checks. Minnesota residents are subject to a 7% sales tax.

Late Payment: Any items that are not fully paid for within 30 days of the end of the auction will be subject to a finance charge of 1% per month. In the event of late payment or non-payment, your future bidding privileges may be cancelled.

Postage and Insurance: All winning bids do not include shipping and insurance costs. These costs will be automatically added to the total of your purchase(s). Shipment of all orders will only be made to the shipping address listed in our records for the winning bidder. All packages are sent by U.S. mail unless otherwise requested.

Returns: There is a five day return privilege from the date you receive your records. You must get prior authorization from Let It Be Records via telephone to return any item. Any item that is returned in any way different from when it left our possession is not returnable. After the five day period has expired, all sales are final and no record may be returned for any reason whatsoever. All records must be received by Let It Be Records within 10 days of approval to return them. The cost of shipping returned items is the responsibility of the person returning them.

*Because it is impossible for Let It Be Records to inspect sealed records to verify any damages, the buyer must accept responsibility for possible damage and there will be no return allowance for these items. Winning bidders have the option of authorizing Let It Be Records to open and inspect sealed items before shipping them. Unless there are major flaws in the record, winning bidders agree to purchase the record for the amount they bid. Let It Be Records assumes that all sealed records are first pressings, but cannot guarantee this. If you request Let It Be Records to open a sealed record that you have the winning bid for, you are still obligated to purchase the record regardless of whether it is a first pressing or not, and the record does not have any major, discernable damage to it.

Loss or Damage of Merchandise: When merchandise is shipped from Let It Be Records, all risk for loss or damage passes to the winning bidder. Any claims for loss or damage become the responsibility of the bidder.

Claims: Let It Be Record's liability for any claim relating to the sale of merchandise, will be specifically limited to, and shall not exceed, the purchase price of any auction merchandise. Further, the parties specifically agree that Let It Be Records shall not be held liable for any incidental or consequential damages relating to the sale or return of any merchandise. By placing a bid in this sale, you agree that this transaction shall be construed in accordance with the laws of the state of Minnesota. Both buyer and seller agree that in the event of any dispute which reguires legal proceedings to resolve, such proceedings will be held under the jurisdiction of the courts of Carver County, Minnesota and that the losing party will pay the prevailing party's reasonable costs involved in settling the dispute.
